Superonline İletişim Hizmetleri A.Ş. (TURKCELL SUPERONLINE), located at Aydınevler Mahallesi İnönü Caddesi No:20 Küçükyalı Ofispark 34854 Maltepe/Istanbul (MERSIS No: 7144494375322904), offering the Foreigners Fiber (24 Months) Campaign (Campaign) since 03.01.2022, I, as an individual subscriber, declare that I wish to benefit from it;
1. I acknowledge that this Foreigners Fiber (24 Months) Campaign Commitment (Commitment) is an integral part of the TURKCELL SUPERONLINE Subscription Agreement (Subscription Agreement), that in cases not covered by this Commitment, the provisions of the Subscription Agreement shall prevail, and that in case of any disputes arising from the application of this Commitment, the provisions of the Subscription Agreement shall apply;
2. I acknowledge that I am either a new or existing individual TURKCELL SUPERONLINE Fiber Internet subscriber of foreign nationality, who has provided the required documents (listed on the page of this Campaign on the superonline.net website), and that I have applied for the campaign through TURKCELL SUPERONLINE field channels (FÇM, DÇM, TİM) or the call center sales channel.
I confirm that I am not currently benefiting from a device gift campaign offered by TURKCELL SUPERONLINE, and that my TURKCELL SUPERONLINE subscription is not suspended;
3. In order to benefit from this Campaign as a new customer, after completing my campaign application, I must first make a payment of 350 TL (Three Hundred Fifty Turkish Lira) including all taxes for the Installation and Activation Services within 2 (two) business days from the SMS notification sent to me.
I must pay this amount either through online channels accepting credit card payments, via FÇM, DÇM, TİM offices using a credit card, or in cash through one of the partnered banks.
Once the payment is completed, I will receive another SMS notification, and the activation process of the Campaign will continue.
If the payment is not made within the specified period, my request to join the Campaign will be canceled.
4. In case my internet service cannot be activated due to technical reasons caused by TURKCELL SUPERONLINE, or if the internet service has not yet started despite being in the activation process, and I choose to cancel my campaign request voluntarily, the 350 TL (Three Hundred Fifty Turkish Lira) Installation and Activation fee I have paid, including all taxes, will be refunded to me as outlined in the subscription agreement.
5. If TURKCELL SUPERONLINE detects one or more of the following situations concerning my individual Fiber Internet Service used under this Campaign, and if TURKCELL SUPERONLINE deems that the service provided within the scope of this Campaign is being used by me in violation of this Commitment for commercial purposes or similar, TURKCELL SUPERONLINE reserves the right to immediately remove me from the Campaign without the need for a written notice and to immediately terminate the benefits provided to me.
In such a case, the 11th article of this Commitment will apply, and my Subscription Agreement will be unilaterally terminated by TURKCELL SUPERONLINE without any need for further notice.
All services provided to me under the Subscription Agreement will be terminated by TURKCELL SUPERONLINE, and legal and penal proceedings will be initiated against me.
6. I declare that I wish to benefit from the Fiber Internet Service offered by TURKCELL SUPERONLINE under the tariff alternatives listed in Appendix-1 within the scope of this Campaign.
From the Fiber Internet Tariffs listed in Appendix-1 (each referred to individually as Tariff), I have selected one by marking the box next to the Tariff.
After signing this Commitment,
i. if I am a new subscriber, the selected Tariff will be applied for 24 months (Commitment Period) following the modem (Modem) installation (Setup) and the activation message sent to my mobile phone number registered in the TURKCELL SUPERONLINE system,
ii. if I am an existing subscriber, the selected Tariff will be applied for the Commitment Period following the activation message sent to my mobile phone number registered in the TURKCELL SUPERONLINE system.
7. Starting from the first month after the activation message is sent by TURKCELL SUPERONLINE under this Commitment, the monthly discounted Tariff amount including all taxes as specified in Appendix-1, along with the Wi-fi 5 or Wi-fi 6 Modem usage fee (depending on my selection), will be invoiced to me each month by TURKCELL SUPERONLINE under "Internet Charges" for the entire Commitment Period.
During this period, I must not cancel my TURKCELL SUPERONLINE Fiber Internet subscription, transfer it to another person, suspend the service, or cause TURKCELL SUPERONLINE to suspend the service.
8. In case I receive fixed phone service from TURKCELL SUPERONLINE through number allocation in addition to the Fiber Internet Service, a minimum usage fee of 4.99 TL (Four Turkish Lira and ninety-nine kuruş) including all taxes will be invoiced to me each month by TURKCELL SUPERONLINE for the entire Commitment Period, according to the terms listed on TURKCELL SUPERONLINE's website (www.superonline.net).
9. After the Commitment Period ends, unless I notify TURKCELL SUPERONLINE in writing or choose to benefit from a different TURKCELL SUPERONLINE campaign, I request and approve that the relevant non-commitment TURKCELL SUPERONLINE Fiber Internet tariff based on my current Tariff selection within the scope of this Campaign will be applied to ensure the continuity of the Fiber Internet Service.
I acknowledge that this does not mean the renewal of the Commitment Period, and the relevant current non-commitment Fiber Internet Tariff indicated on the website will be invoiced to me each month by TURKCELL SUPERONLINE.
Additionally, if I continue to use a Wi-fi 5 or Wi-fi 6 supported modem provided under the Campaign, an additional monthly modem usage fee of 12 TL (Twelve Turkish Lira), including all taxes, will be invoiced to me during the subscription period.
10. I acknowledge that value-added services provided by TURKCELL SUPERONLINE, which I will use in addition to the Tariffs offered within the Campaign, will be invoiced separately within the scope of the campaign or tariff I benefit from, and the terms of any relevant commitments and/or user agreements will apply to these value-added services.
If I choose the ALO Service (TURKCELL SUPERONLINE Fixed Phone Service), my calls will be billed separately according to the current tariff rates listed on the website.
11. In the event that I partially or completely violate my obligations specified in this Commitment and/or the Subscription Agreement, or if I am removed from the Campaign or wish to leave the Campaign before the end of the Commitment Period, or if I unilaterally terminate the subscription established by the Subscription Agreement, or fail to fulfill my obligations under this Commitment or the Subscription Agreement, or if TURKCELL SUPERONLINE terminates the subscription due to one or more violations specified in Article 5 of this Commitment, and/or if it is determined that the information and documents I provided for participation in the Campaign are incomplete or fraudulent, or if the Campaign is being used for commercial purposes or abused, the cancellation fee will be calculated as follows and will be charged to me on the first invoice after the cancellation of the Campaign as a one-time Campaign Cancellation Fee, and I will be automatically removed from the Campaign:
· The total amount of discounts provided by TURKCELL SUPERONLINE for each month from the date the relevant Tariff was defined until the date of the violation (The discount amount including all taxes for the Tariff under the Campaign is listed in the table in Appendix-1), OR
· If it is more favorable to me, the total of the Monthly Campaign Fees that I would owe TURKCELL SUPERONLINE from the date of the violation until the end of the Commitment Period.
12. In the event that I cancel the TURKCELL SUPERONLINE Fiber Internet Service within the Commitment Period, other services provided over the TURKCELL SUPERONLINE internet service (such as the TV+ service) will also be canceled, and the terms of any relevant commitment and/or user agreement will apply to these services.
13. In the event that I wish to terminate the Fiber Internet Service subject to this Commitment, I must notify TURKCELL SUPERONLINE or the TURKCELL SUPERONLINE authorized dealer responsible for initiating the Fiber Internet Service subscription either in writing, via fax (+90 850 502 61 49), or through other methods specified by the relevant legislation.
In such a case, my Fiber Internet Service and all the benefits of this Commitment will be terminated, but Article 11 of this Commitment will apply.
14. Upon confirming this Commitment, if I am a new subscriber, I acknowledge that I have received, depending on my choice, a Wi-fi 5 or Wi-fi 6 modem compatible with the Fiber Internet Service, in a condition where the box has not been opened, torn, damaged, and/or used or refurbished, for which I will pay a monthly usage fee.
I understand that I am responsible for keeping the modem in working condition and that it has been provided to me solely for use during my Fiber Internet Service subscription, with a monthly usage fee.
If my TURKCELL SUPERONLINE subscription is terminated for any reason during the Commitment Period, if I am a new subscriber, I am required to return the modem provided with this Commitment, or if I am an existing subscriber, the modem previously provided by TURKCELL SUPERONLINE, to any TURKCELL SUPERONLINE dealer in working condition and with all parts complete within 10 (ten) days.
If I fail to return the modem to a TURKCELL SUPERONLINE dealer on time, or if I return it with missing or damaged parts from the setup, a charge of 600 TL (Six Hundred Turkish Lira) including all taxes will be invoiced for the Wi-fi 5 modem, or 1200 TL (One Thousand Two Hundred Turkish Lira) for the Wi-fi 6 modem.
15. I understand that if the accessories (Aparatlar) delivered to me along with the modem during installation are not returned to the TURKCELL SUPERONLINE dealer within the period specified in Article 14, and/or are returned incomplete or damaged, TURKCELL SUPERONLINE will charge me the amounts specified in the customer service report (Service Form) I signed with this Commitment for each unreturned/incomplete/damaged accessory.
16. I acknowledge that if I transfer the Fiber Internet Service I received under the Campaign, a relocation fee of 150 TL (One Hundred Fifty Turkish Lira), including all taxes, will be additionally invoiced to me by TURKCELL SUPERONLINE.
17. TURKCELL SUPERONLINE reserves the right to make changes to the scope and/or cost of the Campaign Package listed in Appendix-1 in the following cases and to reflect these changes on my invoices, provided that I am informed through the website in advance within a reasonable time:
· Due to actions by authorized institutions or applicable legislation:
(i) A change in the amount/rate of taxes, duties, fees, and similar financial obligations,
(ii) The introduction of new taxes, duties, fees, and/or similar financial obligations,
· A significant change in macroeconomic indicators, especially inflation.
18. Throughout the period I benefit from this Campaign, I prefer that the billing information related to the services under this Campaign be sent to me only via SMS starting from the first month.
In other words, my billing information will not be sent through any other means.
If I wish, I can request to receive the billing information through other methods by contacting the TURKCELL SUPERONLINE Call Center (+90 532 532 00 00) or through TURKCELL SUPERONLINE Subscriber Centers.
19. I acknowledge that as of the date of signing this Commitment, the cost of the Tariff I selected in Appendix-1 is covered under this Campaign, while other tariffs are not covered.
Accordingly, if I switch to a lower or higher tariff during the Commitment Period after the signing of the Commitment, the current fee of the new tariff, as published on the Website, will be applied to me.
20. I acknowledge that the address specified below is the valid address for any notifications to be sent to me.
Unless I inform TURKCELL SUPERONLINE in writing of a change of address, any notifications sent to the address below will be considered valid, and the legal consequences of such notifications will apply.
21. I acknowledge that TURKCELL SUPERONLINE reserves the right, at any time, to transfer or assign this Commitment or the rights and claims within this Commitment, either partially or entirely, to third parties through unilateral notification.
22. I acknowledge that if a request is made to transfer the Internet Service to a different address due to an address change, TURKCELL SUPERONLINE may provide a different internet service depending on the infrastructure at the new address, or the service may not be provided if the necessary infrastructure is unavailable.
In such a case, if I document my address change with an official document, I may exit the Campaign before the end of the Commitment Period without paying the Campaign Cancellation Fee.
23. I acknowledge that I cannot transfer or assign this Commitment and/or the rights and claims under this Commitment to third parties.
24. I declare that I have read, understood, and accepted this Commitment.
